CORAM:

HON'BLE MR. JUSTICE SANJIV KHANNA HON'BLE MR. JUSTICE NAJMI WAZIRI

O R D E R

% 03.06.2016 Ramakrishna Dutta, by this writ petition, impugns order dated 19th April, 2016 passed by the Principal Bench of the Central Administrative Tribunal, whereby his OA No. 1371/2016 has been dismissed. 2.

The petitioner, it is stated, has filed an appeal against the order of dismissal, which we are told is still pending. 3.

The petitioner in the said OA had impugned two letters dated 25th February, 2016 and 27th March, 2016 written by the National Academy of Customs, Excise and Narcotics. In the first letter dated 25th February, 2016

it is mentioned that the petitioner has been dismissed from service vide order dated 4th February, 2016 and the petitioner would be entitled to retain the residential accommodation allotted to him for a period of one month from the dismissal from service. The petitioner was advised to vacate the residential accommodation by 4th March, 2016. By letter dated 27th March, 2016, the petitioner was informed that he has not vacated the quarter and in case the residential quarter is not vacated, necessary administrative/legal action will be taken against the petitioner.

4.

It is not the case of the petitioner that the respondents are resorting to extra judicial methods or compelling the petitioner to vacate the quarter. The said letters have been written in accordance with the rules. We do not see any reason to interfere and quash the impugned letters. It will be open to the petitioner to contest eviction proceeding, if they are initiated in accordance with law. With the aforesaid observations, the writ petition is dismissed.
