As learned Senior Counsel proceeded to argue the appeal, grappling with the arguments over 20 minutes it surfaced that the requisite grounds with the setting of the scene giving birth to the grounds have not been pleaded in the appeal.

Lest the appeal suffers a dismissal on account of lack of proper grounds urged we permit the appeal to be withdrawn with liberty granted to FAO(OS) (COMM) 33/2016

file a fresh appeal laying a challenge to the impugned order within a period of 15 days from today.

If filed within 15 days limitation issue would not arise for the reason instant appeal has been filed within the period of limitation. 4.

No costs.
