The petitioner has filed the present petition praying inter alia for quashing his transfer order dated 11th April, 2016 whereunder he has been directed to report to CISF, Bhubneshwar on 30th April, 2016 after being relieved from his posting in Delhi.

Mr.Dev P. Bhardwaj, learned counsel for the respondents, appears on advance notice and submits that this is not the first time that the petitioner has been accommodated by cancelling/deferring his orders of posting.
He states that earlier hereto, the petitioner's request for cancelling his posting from CISF Unit CGBS Delhi to ASG Patna had been acceded to. Even thereafter, vide order dated 12th June, 2015, his request for deferring his posting for one year was acceded to but he W.P.(C) 3421/2016
cannot be accommodated for a third time. He further states that the petitioner has remained posted in Delhi for a period of five years and eleven months and even now he is being posted at his Home Zone where there is a Kendriya Vidyalya, where he can admit his children for undertaking further studies. A copy of orders dated 17th May, 2012 and 12th June, 2015 have been handed over by counsel for the respondents and are taken on record.

Learned counsel for the petitioner states that in view of the aforesaid position, he does not wish to press the present petition, which is accordingly dismissed as not pressed along with pending applications. HIMA KOHLI, J SUNIL GAUR, J APRIL 25, 2016 s W.P.(C) 3421/2016
