O R D E R

% 12.05.2016 Learned counsel appearing on behalf of the applicant states that he would not press this application, if this Court were to direct the expeditious disposal of the trial, pending before the ASJ-05, West District, Tis Hazari Courts, Delhi. The applicant had been charged under Sections 302/392 IPC and has been in judicial custody since 22.10.2014.

It is trite to say that it is the constitutional right of every accused to be tried expeditiously, particularly, when his personal liberty is circumscribed as a consequence of the charges framed against him. In view of the foregoing, without commenting on the merits of the case, the trial court is requested to conclude the subject trial, as expeditiously as possible, and preferably within a period of one year from the next date of hearing i.e. 29.07.2016, without granting any unwarranted adjournment to counsel appearing on behalf of the parties.

Liberty is, however, reserved to the applicant to approach this Court afresh in the event the trial is not concluded expeditiously.

The writ petition is disposed of accordingly. A copy of this order be sent to the trial court for necessary information and compliance.
