W.P.(Crl.) No.1404/2018 The grievance of the petitioner in the present petition is limited. According to the petitioner, FIR No.113/2016 was registered at PS Tilak Marg by respondent No.4 as he was cheated by the accused persons for a sum of ₹1,85,000/- pursuant to the order of the learned Metropolitan Magistrate under Section 156(3) Cr.P.C. The petitioner prays that a final report in FIR No.113/2016 at PS Tilak Marg be filed without the intervention of respondent No.4 i.e. the Director of petitioner. It is trite that W.P.(CRL) 1404/2018

after the completion of the charge sheet i.e. after the Investigating Officer/SHO concerned has formulated his opinion, the draft charge sheet is sent to the Public Prosecutor to advice on any legal compliance if any. Thus, the prayer of the petitioner that the charge sheet be filed without being processed to the respondent No.4 cannot be accepted. Learned Additional Standing Counsel for the State submits that investigation in FIR No.113/2016 registered at PS Tilak Marge is complete and a final report based on the opinion of the Investigating Officer/SHO concerned will be filed within six weeks. No further orders are required to be passed in this petition.

Petition is disposed of.
