% 06.09.2016 The petitioner is aggrieved by the order dated 18.04.2012 passed by the Assistant Engineer, Building Plan wherein his application seeking sanction of a building plan qua WZ-139, Lajwanti Garden, New Delhi had been turned down.

After some arguments, on the opposition raised by the respondent that this order is appealable under the provisions of Section 347-B (1)(f) of the DMC Act, learned counsel for the petitioner seeks permission of this Court to withdraw this petition. He

however seeks liberty of this Court to argue all those arguments which are made in the present writ petition which includes the submission that by virtue of a registered sale deed dated 06.09.2010, he had become the owner of this piece of land. Permission is granted. The rights and contention of both the parties are kept open. Dismissed as withdrawn.
