Suit being CS(OS) 245/2015 was transferred to the District Courts. The suit is an IPR matter, and therefore, the same cannot be transferred in view of the judgment of this Court in the case of Guiness World Records Ltd. Vs. Sababbi Mangal, CS(OS) 1180/2011 and connected cases decided on 15.2.2016. Counsel for the defendants in the suit appears and agrees that the suit could not have been transferred.

Accordingly, this transfer petition is allowed and CS(OS) 245/2015 presently pending in the Court of Sh. Gurvinder Pal Singh, ADJ (Central), Tis Hazari Courts, Delhi is recalled to this Court. Copy of this order be sent to TR.P.(C) 23/2016

the concerned transferee court for sending back the suit files to this Court. The suit files be listed on a date after receipt of the same from the transferee court for further proceedings.
