FAO(OS) 165/2016 & CM No.20520/2016 (stay) This is an appeal against the order dated 18.01.2016, passed by a learned Single Judge in OMP 111/2014. The only surviving issue is with regard to the Claim No.10. But that is covered against the appellant by the judgment of a Division Bench of this Court in National Highways Authority of India v. Gammon-Atlanta: (JV), 2013 (4) Arb. L.R. 61 (Delhi) (DB).

Consequently, the appeal is dismissed on the ground that it is covered by the said decision.
