The present appeal under Section 96 read with Order 41 and Section 151 of the CPC seeks following prayers:- "a. accept the present appeal;
b. set aside the impugned judgment and decree dated 02.04.09 whereby the suit bearing number as 117/07 of the appellant was dismissed c. declare the inspection report dated 18.07.07, speaking order dated 28.09.07 and the impugned demand of Rs10.90,407/- raised by the respondent in pursuance to an inspection dated 18.07.07 at the premises bearing no 521,522 Village Neb Sarai, Vasant Kunj as null and void, d. restrain the respondent from contemplating any action pursuant to the inspection report dated 18.07.07, Speaking order dated 28.09.07 and from enforcing the impugned demand of Rs. 10,90,407/- dated 10.10.07. e. refund the amount of Rs.2,81,743/- already deposited by the appellant vide order dated 04.02.03 passed in FAO bearing number 466/07 which was disposed off vide order dated 3.12.08.
f. pass any other order as may deem fit and proper." 3.
