The applications stand disposed of.

During the pendency of these proceedings, the parties have amicably settled their disputes and have entered into the Memorandum of Understanding [MoU] dated 19.09.2024.

The Court has perused the aforesaid MoU and is of the opinion that the parties have voluntarily, without any force or coercion, agreed to the terms of the settlement. They are, therefore, bound by the same. 3.

Therefore, both the applications stand allowed. Accordingly, the suit in RFA 286/2009 stands dismissed and the suit in RFA 324/2009 stands decreed.

The impugned judgment and decree be modified to the extent of the aforesaid MoU. The same shall form part of the judgment and decree. 5.

The applications stand disposed of.
