% 10.01.2018 On behalf of the respondent no. 3, it has been submitted that no reply is sought to be filed.
Vide the present petition, the petitioner has sought quashing of FIR no. 255/2013, PS Sarita Vihar under Sections 406/420/34 of Indian Penal Code, 1860 and all related proceedings pending before the learned MM. At the outset, it has been submitted by the learned APP on behalf of the State that the charge-sheet in the instant case has already been submitted and the cognizance has also been taken place and the alleged commission of offence before the learned Trial Court.
Learned counsel for the petitioner thus, seeks to withdraw the present
petition to urge the contentions before the learned Trial Court in relation to submissions sought to be heard to the present petition. In view of such submissions, the present petition is dismissed as withdrawn with the liberty granted to the petitioner to make necessary submissions before the learned Trial Court at the stage of consideration on charge.
