The present petition under Section 397 read with Section 482 of the Cr.P.C. seeks the following prayers:
"It is, therefore, most respectfully prayed that the orders dated 07/02/2009 passed by Sh. Sanjay Bansal and orders dated 09/04/2009 of taking cognizance and order dated 08/02/2009 of framing of charge for commission of offence 364A IPC and 120B IPC r/w 364/347/354/365/384/467/471 IPC passed by Sh. S.S. Rathi, Ld. ASJ, Delhi may kindly be set-aside and the petitioner be discharged for commission of offences U/s 364A IPC and 120B IPC r/w 364A/347/354/365/384/467/471 IPC.
It is therefore prayed that the case may kindly be ordered to be remanded back to the court of Magistrate for further trial, in the interest of justice.
Any other or further relief which this Hon'ble Court deem fit, proper and expedite may also be passed in favour of the petitioners." 2.
Learned SPP for the CBI submits that the present petition has become infructuous on account of the fact that the final judgment in the present case has been passed by Sh. Vimal Kumar Yadav, Ld.
