Learned counsel for the parties have returned with instructions. 2.

Mr. Wadhwa, learned senior counsel, who, appears for the petitioner, on instructions, says that the petitioner's nominee Arbitrator is Mr. Justice Mukul Mudgul, former Judge of this Court.

Mr. Batra, learned senior counsel, who, appears for the respondent, says that the respondent's nominee Arbitrator is Mr. Justice S.S. Nijjar, former Judge of the Supreme Court.

Learned counsel for the parties say that the learned Arbitrators will mutually decide upon who would preside over the Arbitral Tribunal. 4.1 The said statement is taken on record.

At this stage, Mr. Batra says that the respondent may want to move an application under Section 16 of the Arbitration and Conciliation Act, 1996. 5.1 If and when such an application is moved, I have no doubt that the Arbitral Tribunal will take an appropriate call in the matter. 6.
