Criminal Revision Petition bearing CRL.REV.P. 431/2010 under Section 397 and 401 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC.') read with Section 482 Cr.P.C,. has been filed on behalf of the Petitioner against the Judgment/Order dated 12.08.2010 of learned ASJ-02 (South), Patiala House Courts, New Delhi whereby the Petitioner was convicted vide Judgment dated 22.11.2007 under Section 304-A IPC and Order on Sentence dated 29.11.2007 vide which he was sentence to RI for two years along with fine of Rs.10,000/-, in default of payment of fine, they have to go further Sentence of RI for six months under Section 304-A IPC.

The Petitioner went in Appeal before the learned ASJ, who vide The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Judgment dated 12.08.2010 enhanced the compensation amount to Rs.2.5 Lakhs.

Against that conviction, present Criminal Revision Petition was filed by the Petitioner whereby he was directed vide Order dated 17.08.2021, to deposit the fine amount before the learned Trial Court in the form of an FDR. It is now submitted that Dr. Parmar has died on 09.01.2023. Death Verification Report has been filed by the SHO, New Delhi wherein the death of Dr. Omkar Parmar has been verified. Let the same be taken on record .The present Criminal Revision Petition stands abated. 4.

The Complainant had filed an Application No. 18823/2024 under Section 482 Cr.P.C. seeking release of compensation to the Applicant, Prem Kumar Batra, father of Master Gaurav Batra, the child, who died. Along with this, CRL. M.A. 16353/2025 under Section 528 B.N.S.S., has been filed on behalf of Smt. Santosh Batra wherein it is submitted that Mr. P.K. Batra, who had filed the earlier Application, has expired on 19.12.2023 and hence, his wife, Smt. Santosh Batra is sought to be substituted in his place. 5.

In view of the survival and the Death Certificate annexed with the Application, Smt. Santosh Batra is substituted for Mr. P.K. Batra, in Application bearing M.A. No. 18823/2024. The Application is accordingly disposed of.

Since Dr. Parmar has been died, his wife and daughter have been served and brought on record. The amended Memo of Parties is placed on record. Ms. Puneet Parmar has appeared in person today for herself, as well as, for her mother, Smt. D. Parmar. She admitted that she has no objection if the compensation amount of Rs.2.5 Lakhs, is released to the Complainant Smt. Santosh Batra, the mother of the deceased. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In view of the submissions made, the compensation amount along with the interest that may have accrued be released to Smt. Santosh Batra, the mother of the deceased, in accordance with law, on proper identification. 8.

The pending Applications, as well as, the Criminal Review Petition is accordingly disposed of.
