% 24.05.2018 All the parties are present in Court. Report from the mediation centre has been received. Settlement Agreement dated 4th May, 2018 has been entered into between the parties. Terms of settlement are contained in paragraphs (a) to (k) of the Settlement Agreement. As per the said settlement, Respondent No.1 Mr. Sushant Mahapatra has agreed to transfer his share and rights, title and interest thereof in property bearing no.175-A, New DDA Janta Flat, Shahpur Jat, New Delhi in favour of Appellant upon receiving the payment of Rs.26 Lakhs from Mr. Anant Narayan Ray or his father Mr. Rabindra Kumar Ray. The amount of Rs.26 Lakhs is to be paid on or before 10th January, 2019. Upon the payment being received, Mr. Sushant Mahapatra shall have no rights in the property. The said payment shall be towards all rights including mesne profits as awarded. The suit is
decreed as per terms of the settlement. The terms of the settlement shall form the part of the decree. The decree sheet be prepared upon receipt of payment. Ms. Gayatri Devi, the Respondent No.1 i.e. the confirming party shall execute the Power of Attorney in favour of the Appellant Mr. Anant Narayan Ray or his father Mr. Rabindra Kumar Ray. If the amount is paid by cheque, the Appellant shall ensure that the amount is credited to the Respondent's bank account on or before 10th January, 2019. Upon the payment being received and the Power of Attorney being executed, the parties shall appear before the Trial Court and seek release of the original documents in favour of the Appellant. Original trial court record be sent back.
The appeal is disposed of as settled.
