% 04.05.2018 After some arguments, Mr.Sanjay Sharawat, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to approach the respondents by way of a statutory appeal. He further submits that since the appeal would now be time barred, he will also be moving an appropriate application for seeking condonation of delay in filing the appeal.
Learned counsel for the respondents, who appears on advance notice submits that, in case, the petitioner files such an appeal alongwith application for condonation of delay, the respondents would consider the application for condonation of delay on its own merits and depending upon its decision on the application, the appeal will be disposed of by following the prescribed procedure. The present petition is accordingly dismissed as withdrawn with liberty, as prayed for.
