CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 08.05.2018 It is submitted that petitioners and respondent no.2 have settled their disputes amicably vide Compromise Deed dated 1st May, 2018, therefore, FIR No. 608/2017 under Sections 279/323/341/308/34 IPC and the consequent proceedings emanating therefrom may be quashed. It is noted that after investigation charge-sheet has been filed wherein offence under Section 308 IPC has been converted into Section 307 IPC. Respondent no.2 is present in Court along with his counsel.

He has been identified by SI Arvind Kumar of police station Vivek Vihar. He submits that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion, therefore, he has no objection in case FIR is

quashed. Petitioner no.3 has paid `25,000/- to the respondent no.2 today in Court in order to compensate him in terms of mental pain and agony. As regards petitioner nos. 1 and 2 are concerned, they have offered to deposit `25,000/- each with the Delhi High Court Advocates Welfare Trust during course of day. Let petitioner nos. 1 and 2 deposit `25,000/- each with the said Trust during course of the day and receipt thereof, be handed over to the Investigating Officer.

Keeping in view the settlement arrived at between the petitioners and respondent no.2 voluntarily, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed, subject to aforestated deposits made by the petitioners.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.

Dasti.
