O R D E R
% 18.05.2016 The present petition has been filed seeking modification of the bail order dated 18.03.2016 passed by the Sessions Judge and also for setting aside the order dated 19.04.2016 passed by the Court of Sessions dismissing the modification application filed by the petitioner.
Vide order dated 18.03.2016, the petitioner was granted bail with certain conditions, one of which was :
"The applicant/accused shall surrender his passport (if not surrendered earlier) before
the learned Trial Court at the time of furnishing bail bond/surety bond."
It has been submitted by the learned senior counsel for the petitioner that the passport issued in the name of the petitioner has been lost and is not available with him.
On the other hand, the learned APP for the State has submitted that they had enquired from the passport authorities whether any passport has been issued in the name of the petitioner or not and they have got a response from the passport authorities that they are unable to find out whether any passport has been issued in the name of the petitioner.
In the facts and circumstances, the order dated 18.03.2016 is modified to the extent that the petitioner/accused shall furnish an indemnity bond for sum of Rs.5,00,000/- with the undertaking that he shall not leave the country without prior permission of the court. The petition accordingly stands disposed of.
