The petitioner seeks quashing of FIR No.475/2014 under Section 323/341/34 IPC; Police Station Vasant Kunj North. 2.

It is alleged in the FIR that when the complainant was returning home from Rohtak at about 9:30 pm, he got stuck in a traffic jam. While reversing, his car collided with another vehicle. The occupant of the said vehicle came out; started abusing the complainant and his wife and thereafter even assaulted his wife. It is contended in the FIR that the complainant could not note the entire number of the vehicle and could only note the vehicle as Nissan Micra, Colour Blue with 'DL-7407'.

Learned counsel for the petitioner contends that the petitioner society owns a vehicle which is Nissan Micra, Colour Blue bearing No.DL-1CQ-7047 and was issued notice by the Police. It is contended that the said vehicle owned by the petitioner Society, was not a vehicle which is referred to in the subject FIR. 4.

Learned APP has filed a status report contending that despite sincere efforts no clues could be found with regard to the culprit and the present case has been sent as 'untraced' on 19.01.2018. 5.

The status report is taken on record.

Learned counsel for the petitioner submits that in view of the status report having been filed, no cause survives qua the petitioner. Accordingly, he does not wish to press the present petition. 7.
