The present appeal is directed against the order dated 23.07.2008 passed by the Trial Court, whereby the appellant's application under Order IX Rule 13 came to be dismissed. Since the last several dates of hearing, there has been no representation on behalf of the parties, resulting in the issuance of repeated Court notices to both the parties as well as their respective counsels. On 24.02.2026, this Court noted that, on previous occasions, all efforts to serve the parties, particularly the appellant and their counsel, had remained futile. As per the office report, the counsels remained unserved, and the appellant was also not found residing at the address mentioned.

On the last date of hearing, a fresh Court notice was directed to be issued through registered post. As per the office report, the appellant remains unserved, as no such firm or person, namely Mr. Arun Saxena, was found working or residing at the said address.
