Now, as many as on three occasions, process fee has not been filed for service of respondent no.2. Respondent no.2 in the appeal was the respondent no.1 before the Employee's Compensation Commissioner and was sued as he was the employer of the appellant and the owner of the subject vehicle.

The three dates for which process fee has not been filed and hence no steps have been taken for service of respondent no.2 are 10.11.2016, 23.01.2017 and today i.e. 17.07.2017. 3.

This appeal is accordingly dismissed in default and for nonprosecution. 4.

Let no application for restoration/recall of this order be entertained unless costs of Rs.20,000/- are first deposited with www.bharatkeveer.gov.in.
