Heard learned counsel for the parties.

The petitioner has been denied employment to the post of an Assistant Sub-Inspector in the OBC category on account of he submitting the OBC certificate after the cut-off date. The cut-off date was April 28, 2015. The certificate in question was issued by the competent authority to the petitioner on November 18, 2015 and was submitted by the petitioner at the time of interview i.e. before the selection process was over. 3.

View taken by the Division Bench of this Court that belatedly filed certificates cannot be received by the department because it creates administrative inconvenience has been over-ruled by the Supreme Court on February 24, 2016. The decision is in CA No. 1691/2016 Ram Kumar Gijroya Vs. DSSSB & Anr.

Accordingly, the petition is disposed of directing respondents to verify the authenticity of the OBC certificate submitted by the petitioner and if found to be genuine, to proceed ahead by offering appointment to the petitioner, if the petitioner's merit position is such which entitles him on the strength of OBC category candidate to be offered appointment as an Assistant Sub-Inspector in the applicable Central Para-Military Force with respect to which the petitioner has given the option. 5.

Needful shall be done within eight weeks from today. 6.

No costs.
