By this petition the petitioner seeks parole on the ground that he has to file Special Leave Petition.

Application of the petitioner was rejected by the competent authority for the reason that one year period had not elapsed since the petitioner was in continuous custody. Petitioner was released on bail during the course of trial and on his conviction vide judgment dated 9th August, 2017, he surrendered to custody.

The appeal was also decided when the appellant was in custody. The period of continuous custody of the appellant even now is less than one year. W.P.(CRL) 1392/2018

Since there is no error in the impugned order of the competent authority rejecting grant of parole as it is inconsonance with the guidelines laid down, this Curt finds no ground to interfere with the impugned order. 5.

Petition is dismissed.

Copy of the order be communicated to the petitioner through Superintendent, Tihar Jail.
