% 19.12.2016 Counsel appearing on behalf of the parties state that they have arrived at an amicable settlement of the underlying dispute. The terms of the settlement are incapsulated in a communication dated 3.11.2016, a copy of which has been handed over in court today. The same is taken on record leaving the parties to comply with the terms and conditions thereof without demur.

In view of the foregoing, Mr. Wali, learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition with liberty to revive the same in the event the terms of the settlement are not complied with by the respondent company.

Leave and liberty is granted.

The petition is dismissed as withdrawn.
