O R D E R
% 03.07.2018 By order dated 25.05.2018, the prayer of the petitioner/applicant as made in the application (Bail Application 1002/2018) for release on anticipatory bail in the event of he being arrested in case FIR No.97/2018 under Sections 406/420/467/471/34 IPC of police station Punjabi Bagh, was granted subject to certain conditions inclusive of deposit of ` 50 lakhs with the Registrar General of this Court within the period specified. It appears the applicant was unable to muster necessary money for such deposit to be immediately made.
He deposited ` 10 lakhs and on his request he was granted extension of time and in the interregnum he was permitted to place on record the title deeds of the property of his parents. The balance money
i.e. ` 40 lakhs is stated to have since been also deposited with the Registrar BAIL APPLN. 1002/2018
General.
In terms of order dated 01.06.2018, the title deeds of the property of the parents of the applicant are to be returned after such deposit of money has been made. No further directions in that regard are, thus, called for. The applicant, however, prays for two modifications of the order dated 25.05.2018; (1) that the money i.e. `50 lakhs which he has deposited, may be put in fixed deposit receipt so that it does not remain idle and (2) that the condition that he shall not leave "the city" being harsh may be waived.
Having heard both sides, this Court finds good reasons for modification of the above mentioned conditions in the order dated 25.05.2018.
Thus, while the anticipatory bail order as granted on 25.05.2018 would stand, the above conditions would be read qualified/modified as under:-
(1) The amount of ` 50 lakhs which is stated to have been deposited by the petitioner will be put in fixed deposit receipt in a nationalised bank for a period of six months with provision for auto renewal till further directions;
(2) The petitioner would not leave India except with prior permission of the trial court and to ensure due compliance he shall be obliged to deposit his passport with the court of concerned Magistrate within a week hereof.
This disposes of the petition and pending applications. Dasti.
