% 09.05.2017 Petitioner nos. 1, 2, 3 (i) to 3 (iii), 4 and 5 have filed administration bond dated 19.04.2017, Ex. P-1. The same is on record. Petitioner no.1 Mr. Manmohan Sankhdher alongwith two sureties namely Mr. Divya Bhushan Sharma and Col. Anand Prakash are present. The surety no.1, Mr. Divya Bhushan Sharma has furnished copies of his four FDRs in the total sum of Rs. 2,07,36000/- as security. The same are marked as Mark A to Mark D.
Surety no. 2, Col. Anand Prakash has furnished copies of two FDRs in the total sum of Rs. 87,50,000/- as well as copy of tripartite sub-lease deed dated 08.03.2013 in respect of his immovable property i.e. Flat no.4C702, Gurjinder Vihar, AWHO Complex, Greater Noida, U.P. which he has TEST. CAS. 74/2011 1/2
purchased for a sum of Rs. 38,13,344/- as security. The same are marked as Mark E, F and G. Surety no. 2 has stated that the current market value of the said flat would be around Rs. 1.4 crores. Statements of the petitioner no. 1 and sureties are recorded separately. The securities furnished by sureties are hereby accepted. The original sub-lease deed and above said FDRs are returned after making the endorsements.
Registry is directed to send the intimation to concerned sub-registrar office informing that surety no.2 has furnished sub-lease deed in the present case as security and further directed not to register/create any sale/transfer/alienation in respect of the said property till further orders from this Court and an entry to this effect be duly recorded in their records. Registry is also directed to send intimation to concerned banks informing that surety no. 1 and surety no. 2 have stood as surety in the present case and furnished their FDRs.
Administration Bond furnished by the petitioners are hereby accepted. Registry is directed to issue Letter of Administration to the petitioner in terms of order dated 07.12.2016.
