Crl. M.C. 1154/2017 & Crl. M.A. 4754/2017 Learned counsel for the petitioner submits that the petitioner wants to join the proceedings however, the Court below has passed proceedings under Section 82 Cr.P.C. against the petitioner. He further submits that the petitioner wants to withdraw the present petition with liberty to file appropriate application.

In view of the submission made by the learned counsel for the petitioner, the present petition as well as the accompanying application are dismissed as withdrawn, with liberty to file appropriate application before

the Trial Court, which shall proceed with the matter in accordance with law. Petitioner is directed to appear before the Trial Court on or before 24th March, 2017. The impugned order is modified accordingly. Copy of this order be given dasti, as prayed. I.S.MEHTA, J MARCH 21, 2017/km
