% 13.05.2016 CM No.18043/2016 This is an application under Section 151 CPC filed on behalf of the petitioner seeking permission to furnish bank guarantee and to grant further 30 days.
The petitioner had challenged order dated 30.03.2016 passed by learned Presiding Officer, Employees Provident Fund Appellate Tribunal in ATA No.906(4)2015 titled as 'Tirath Ram Ahuja Pvt. Ltd. vs. APFC, Delhi' whereby the application under Section 7-O of the Employees' Provident Fund & Miscellaneous Provisions Act (for short 'the Act') was disposed of and the petitioner was directed to deposit 40% of the assessed amount.
On 29.04.2016 when the matter was taken up for hearing, Mr.S.K. Gupta, learned counsel for the petitioner submits that the
petitioner is ready to deposit 30% of the assessed amount as predeposit within a period of 30 days. Learned counsel for the respondent did not object the same.
The petition was disposed of with the directions that pre-deposit amount be reduced to 30% and the petitioner was directed to deposit the same within 30 days. In the present application, the petitioner seeks modification of the said order.
In view of the fact that learned counsel for the petitioner submitted that petitioner is ready to deposit 30% of the assessed amount within 30 days, no modification is called for. The application is therefore, dismissed.
