On the previous date Mr. Ravi Rai, who is an associate of Mr. Rajiv Narain had appeared. I am told that main counsel engaged by the respondent in the matter is Mr. Rajiv Narain, Advocate. 2.

I am informed that respondent has no objection to this Court appointing an Arbitrator in view of the fact that the Arbitrator, who was till now adjudicating the dispute between the parties has withdrawn from the proceedings on account of his ill health.

Accordingly, Mr. B.B. Choudhary, Former ADJ (+91 9910584611) is appointed an Arbitrator. The learned Arbitrator will continue with the proceedings from the stage at which it is presently positioned. The learned ARB.P. 362/2018 Page 1 of 2 Arbitrator will be paid fees in terms of the Fourth Schedule, appended to the

Arbitration and Conciliation Act, 1996.

Mr. Rajiv Narain, learned counsel will file his vakalatnama within one week from today.

The petition is, accordingly, disposed of.

The Registry will dispatch a copy of this order to the learned Arbitrator.
