Malik, Advocate, on instructions, states that the civil suit filed by the respondent has since been finally disposed of by the Court of learned Additional District Judge-05, Patiala House Courts, Delhi ('ADJ') by a judgment and decree dated 11.01.2019. She seeks permission to withdraw the appeal with liberty to raise the necessary grounds taken in this appeal, in the regular second appeal which the appellant seeks to file against the final judgment and decree. 8.

In the circumstances, the petition is dismissed as withdrawn with such liberty.
