Crl. M.C. No. 1612/2016 By this petition filed under Section 482 read with Section 439(2) of Cr. P.C., the petitioner seeks to challenge the judgment and order dated 09.02.2016 passed by this Court in Crl. M.C. No. 1621/2013, whereby respondent No. 2 was granted condition bail. Learned counsel for the petitioner seeks cancellation of condition No.(vi) imposed upon respondent No. 2, i.e., for depositing a sum of Rs.50 lac with the trial Court by way of bank draft as a security.

After some arguments, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to take appropriate remedy before the Trial Court.

In view of the aforesaid stand taken by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty as prayed for.
