% 31.10.2017 The parties have entered into a Settlement Agreement dated 08.08.2017 before the Delhi High Court Mediation and Conciliation Centre, New Delhi.
The learned Joint Registrar has noted the statements of the parties to the settlement whereby defendant Nos.2 and 4 have confirmed their signatures on the Settlement Agreement.
In view of the Settlement Agreement dated 08.08.2017, the suit is decreed in favour of the plaintiff and against defendant Nos.2 and 4. A decree sheet may be drawn up incorporating clauses, namely, i, ii, iii, iv, v, vi and vii of the Settlement Agreement.
The matter has already been settled with defendant No.1 as noted in order dated 31.08.2016 passed by this court.
Regarding defendant No.3, the learned counsel appearing for the plaintiff states that he wishes to withdraw the present suit against defendant No.3 with liberty to file a fresh suit when such an eventuality arises.
Granting leave and liberty as prayed, the present suit against defendant No.3 is dismissed as withdrawn.
Suit is disposed of as above. All the pending applications, if any, is also disposed of.
In terms of Section 16 of the Court Fees Act, the plaintiff is also entitled to the court fees.
