The present petition has been filed by the petitioner praying inter alia for staying the inquiry proceedings initiated against him in terms of the charge-sheet dated 9th June, 2015 and further, for directions to the respondents to refer his case for verification of his caste certificate to the Scrutiny Committee constituted by the Government of Rajasthan in terms of decision of the Supreme Court in Km. Madhuri Patil Vs. Addl. Commissioner Tribal Development 1994 (6) SCC 241. 2.

On the last date of hearing, it was recorded that the main contention of the learned counsel for the petitioner is that prior to issuance of the charge-sheet, the respondents had failed to issue any W.P.(C) 3674/2016

Notice to Show Cause to the petitioner and he was not afforded an opportunity to place his defence before the competent authority. Learned counsel for the respondents, who had appeared on advance notice, had sought time to obtain instructions from the department. 3.

Today, learned counsel for the respondents has handed over a copy of the letter dated 7th May, 2016 addressed by the Railway Protection Force to the Divisional Commissioner, Jaipur asking for verification of petitioner's caste certificate and he states that till the Scrutiny Committee constituted by the Government of Rajasthan gives its opinion, the respondents shall stay their hands in respect of the charge-sheet issued to the petitioner.

The aforesaid document is taken on record with a copy thereof furnished to the learned counsel for the petitioner. 5.

The present petition and the application are accordingly disposed of with direction to the respondents to stay their hands and await the report of the Scrutiny Committee appointed by the Government of Rajasthan and only thereafter take further proceedings, if necessary.
