By virtue of the present application, the parties seek disposal of the present appeal in view of the Memorandum of Understanding/ Settlement Agreement dated 17.11.2025, duly executed by the parties. 2.

Although the captioned application is under Order 23 rules 1 & 3 of CPC, however, learned counsel for the appellant seeks to withdraw the present appeal in terms of provisions of Order 23 Rule 1 of CPC. 3.

Accordingly, the present application is allowed and disposed of. RFA 451/2011 & CM APPLs. 22104/2011, 34288/2023, 66430/2025 4.

In view of the order passed today in CM APPL. 75752/2025, the present appeal, alongwith the pending applications, is dismissed as withdrawn.
