% 08.08.2016 CM No. 20937/2016 (O. 23 R. 3 of CPC) This application seeks disposal of the writ petition in terms of the settlement having been arrived at between the petitioner and respondent no.2. According to the petitioner the dues have been settled at a lump sum amount of Rs. 1.45 lacs payable to respondent no.2. The said amount has been paid to the said respondent through a cheque drawn on HDFC Bank dated 05.08.2016 bearing no. 186564 in the name of Mr. Tarun Pal, respondent no.2. Learned counsel for the petitioner submits that the cheque is good for encashment.

The cheque has been handed over to learned counsel for respondent no.2, Mr. P.N. Dwivedi, and he has satisfied himself of its particulars. He says upon instructions that the matter stands settled with the petitioner. The application is allowed. The petition stands disposed off in terms of the above. The amount of Rs. 2.46 lacs, as stated by the learned counsel for the petitioner, which stands deposited in the court shall be returned to the

petitioner along with the interest earned thereon on the petitioner approaching the registry with a proper application.
