BAIL APPLN. 1023/2018 Petitioner seeks pre-arrest bail in FIR No.259/2017, under Sections 498A/406/34 of IPC, registered at police station Mahendra Park, Delhi. While entertaining this application, parties were referred to mediation and interim protection was granted to petitioner. However, mediation has failed.
Learned Additional Public Prosecutor for respondent-State submits on instructions that petitioner had brought dowry articles to be returned to the complainant, but the complainant did not accept it by stating that they are not in good condition. It is stated that some of the dowry articles have BAIL APPLN. 1023/2018
not been returned.
Learned counsel for petitioner submits that without prejudice to the rights of petitioner, a sum of ₹ 2 lacs would be deposited with trial court within a period of three months. Let the aforesaid deposit be converted into FDR with automatic renewals till the proceedings in this FIR case comes to an end.
Without commenting upon merits of this case, interim order of 27th September, 2018 is made absolute. In the event of arrest, petitioner be admitted to bail, subject to his furnishing bail bond in the sum of `15,000/- with one local surety of the like amount to the satisfaction of Investigating Officer/Arresting Officer. It is made clear that in case petitioner fails to make aforesaid deposit within the above stipulated time or to join investigation, then the respondent-State shall be at liberty to get this order revoked.
With aforesaid directions, this application is disposed of. Dasti.
