% 11.05.2018 Petitioner's grievance is that the rejection of his bids on the one hand and the acceptance of another tenderer's bid on the other is arbitrary. He has levelled several allegations of irregularities with respect to the status of third party, especially it is JV, on the basis of the documents furnished.
Counsel for the respondent - National Highway Infrastructure Development Corporation Limited (NHIDCL) submits on advance notice that the said agency/respondent after due consideration has now decided to cancel the bid and the entire tender process. It is further stated that fresh tender would be issued. In support of this,
learned counsel has produced the copy of the Evaluation and Analysis of the Bidding Process dated 09.5.2018 which in its para 7 details all the irregularities alleged by the petitioner/complainant which were prima facie found to be true and correct. In the circumstances, the Court is of the opinion that since the respondents have effectively accepted the petitioner's grievance which has resulted in the cancellation of tender process, the claim proceedings are rendered academic.
Writ petition accordingly dismissed.
