IN THE HIGH COURT OF DELHI AT NEW DELHI
+ O.M.P. (COMM) 176/2016 NATIONAL HIGHWAYS AUTHORITY OF INDIA.... Petitioner Through Ms.Neha, Advocate versus EMAS EXPRESSWAY PVT LTD ..... Respondent Through Mr.S.K.Chandwani, Advocate
CORAM:
HON'BLE MR. JUSTICE JAYANT NATH
O R D E R
% 22.08.2017 I.A.No.6202/2017 1.
This is an application filed under Section 152 of the CPC seeking correction of some typographical/clerical errors in the order of this court dated 17.04.2017.
2.
It has been pleaded in the application that there are certain typographical mistakes in paras 31 and 35 of the order. It is pointed out that in para 31, the reference was made to Article 1.1 in respect of the taxes and levies if any payable in an accounting year. It is urged that this is a typographical error as reference is to be Article 11.1 and not Article 1.1. 3.
It is further urged that in para 35, the court had noted the revised figure for the claim was Rs.1,36,26,630/-. It is urged that this is also a typographical error as this figure should be read as Rs.1,77,86,305/-. 4.
The learned counsel appearing for the petitioner submits that she has no objection to the aforenoted corrections as noted in the present application.
5.
The third aspect which is sought to be argued is regarding the interest @ 18% noted in para 35 of the order. Needless to say that the interest would be as per the award.
6.
Accordingly, the application is allowed. The aforenoted corrections in paras 31 and 35 may be read in the order dated 17.04.2017. JAYANT NATH, J.
