O R D E R

% 17.05.2018 Mr. Makhija, learned CGSC, appearing for the petitioner i.e. Union of India, on instructions, has restricted his challenge qua the impugned order passed by the National Human Rights Commission (in short 'Commission') to only one aspect, which is, vis-a-vis the observations made therein that the Union of India is vicariously liable to pay compensation to the affected persons.

Mr. Makhija says that while the Union of India, Ministry of Finance, Department of Financial Services, has no difficulty in paying the compensation, as ordered by the Commission, the said observations be expunged.

It is not disputed by Mr. Makhija that the concerned Debt Recovery Tribunal is under the administrative control of the Union of India, Ministry of Finance.

Thus, having regard to aforesaid, in these circumstances, the writ petition is disposed of with liberty to the Union of India to move the Commission for making the aforestated request. 5.

In the meanwhile, the Union of India will deposit the compensation, so ordered, via the impugned order, with the Commission within one week from the date of the receipt of a copy of the order.

Pending application shall stand closed.
