This public interest petition has been filed seeking a direction to the respondents to remove the encroachments from the roads mentioned therein and to restore the width of the said roads to the original width. 2.

Mr.Gautam Narayan, the learned ASC appearing for the GNCTD/respondents 1 to 4 has at the outset pointed out that some of the roads mentioned in the writ petition are situated within the jurisdiction of South Delhi Municipal Corporation (SDMC). Since SDMC is not arrayed as a respondent to the present petition, we hereby implead SDMC as respondent No.5. The amended memo of parties be filed by the petitioner. Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.

Mr.Mukesh Gupta, the learned Standing Counsel for SDMC accepted notice for the impleaded respondent No.5.

Having heard the learned counsel for both the parties and having regard to the nature of the cause sought to be espoused in the writ petition, we consider it appropriate to dispose of the writ petition with a direction to the respondent Nos. 1 to 5 to look into the issues raised in this petition by treating the same as a representation and take appropriate action following due process of law for removal of encroachments.
