% 13.02.2019 CRL.REV.P. 349/2016 & Crl.M.A.7734/2016 (for condonation of delay) 1.

Petitioners impugn order dated 20.10.2015, whereby, interim maintenance was assessed at Rs.6,000/- for the petitioner and the minor child.

Learned counsel for the parties inform that the proceedings before the Trial Court had continued and evidence is over and matter is listed on 06.03.2019 for final arguments on the main petition under Section 125 Cr.P.C.

Since the matter is already listed before the Trial Court after evidence, the Trial Court is directed to expedite the proceedings and endeavour to conclude the same by 31.03.2019. CRL.REV.P. 349/2016

Since the petitioner has impugned an order of interim maintenance the trial court proceedings are at the final stage and is likely to be concluded shortly and the decision therein shall also finally determine the interim maintenance, I am of the view that the it would be in the interest of justice to dispose of this petition reserving liberty of the parties to take legal recourse after the final order is passed.

In view of the above, the petition is disposed of with liberty to the petitioner to impugn the final order, in case the need so arises. 6.

All rights and contentions of the parties are reserved. 7.

It is clarified that this Court has neither considered nor expressed any opinion on the merits of the contentions of either of the parties.
