% 22.10.2018 Learned counsel for the petitioner submits that pursuant to the initiation of these proceedings, a fresh tender process is under way. Public notice has been issued.

Learned counsel also states that the petitioner may be granted liberty to initiate appropriate proceedings for the recovery of the EMD amount, which has been forfeited. The bank guarantee amount has already been encashed by the respondents. Likewise, it is submitted that in case of any coercive action, the petitioner's rights to proceed in accordance with law against the grievance may also be reserved.
