O R D E R

% 04.11.2016 The suit has already been decreed against defendant nos.1 & 2. Defendant nos.3 to 5 are entities which operate e-commerce sites. Defendant nos.3 to 5 are admittedly intermediaries within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. The learned counsel for the defendants has also pointed out that their conduct is regulated under the Information Technology Act, 2000 and the Information Technology (Intermediaries Guidelines) Rules, 2011. They further state that they are bound to act in accordance with the aforesaid rules and in the event any information is provided which requires them to remove the display of any product in compliance with the said rules, the same would be done. In

this view, the learned counsel for the Plainitff does not wish to press the suit against the said defendants.

The suit is, accordingly, dismissed as not pressed with respect to defendant nos.3 to 5.
