Mr. Jitendra Singh, Advocate has entered appearance on behalf of respondent No.2. He submits that he will be filing his vakalatnama during the course of the day. He further submits that no reply is required to be filed on behalf of respondent No.2 in the present case, as the alleged cheque was not issued by respondent No.2.

Learned counsel for respondent No.2 further submits that he has no objection, if the petitioner's application under Section 91 Cr.P.C. with respect to summoning the Bank records pertaining to Account No.344 in respect of cheque bearing No.175362 of Vysya Co-operative Bank Limited, Branch B.V.K.Iyenagar Road Branch No.226, 1st Floor, Chickpet. Bangalore-560053 is allowed. He submits that the respondent has taken a stand in the trial that he is neither associated with the firm nor issued the cheque in question.

In view of the aforesaid submission made by learned counsel for

respondent No.2, the present petition is allowed and stands disposed of accordingly along with the pending application. 4.
