+ CRL.M.C. 2853/2018 SONU @ DEVENDER & ORS .... Petitioners Through Mr. Rajesh Kumar, Adv versus STATE GOVT OF NCT OF DELHI & ORS ..... Respondents Through Mr M S Oberoi, APP for State SI R S Pandit, PS Preet Vihar

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 24.05.2018 Notice. Learned APP accepts notice on behalf of respondent no.1.

Respondent nos.2 and 3 are present in the court and accept notice.

It is submitted that petitioner and respondent nos.2 and 3 have settled their disputes amicably in terms of Compromise Deed dated 2nd April, 2018, therefore, FIR No. 316/2009 under Sections 308/34 IPC registered at police station Preet Vihar may be quashed. Respondent nos.2 and 3 have been identified by SI R S Pandit of police station Preet Vihar. They admit having settled the matter with the petitioner of their own free will and without any undue force, pressure or coercion vide Compromise Deed dated 2nd April, 2018 and say that they have no objection in case the FIR is quashed.

Keeping in mind the settlement arrived at between the petitioner and respondent nos.2 and 3 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending.

Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J MAY 24, 2018 sm
