% 24.03.2017 After some arguments, learned senior counsel for the petitioner, on instructions, states that the petitioner wishes to withdraw the petition with liberty to file afresh after the evidence of the prosecutrix is recorded. He further submits that since the next date fixed before the Trial Court is 2nd and 3rd June 2017, the petitioner shall also move an application for preponement of the date, so that the evidence of the prosecutrix could be recorded earlier. In case such an application is moved, the Trial Court may consider the same favourably looking to its diary and availability of the witness. The evidence of the prosecutrix shall be recorded without any delay. No undue
adjournment shall be granted to any party.
