Petitioner seeks quashing of FIR No.336/2017 under Sections 420/354 IPC, Police Station Rajouri Garden, based on a settlement. 2.

As per the complainant, the petitioner is stated to have misrepresented to her and taken sum of Rs. 5 lacs for the purposes of obtaining a job for her and further misbehaved with her. 3.

Parties have settled their dispute. Terms of the Settlement have been recorded before the Trial Court on 21.04.2018 and subsequently a Settlement Agreement dated 21.04.2018 has been executed between the parties. As per the Settlement, the petitioner has agreed to pay a sum of Rs.1,80,000/- to the respondent/complainant towards full and final CRL.M.C.2421/2018

settlement of all her claims.

A sum of Rs.80,000/- has already been paid and balance amount of Rs.1,00,000/- has been paid by way of Demand Draft bearing No.572819 dated 07.05.2018 issued by the Canara Bank, Rajouri Garden Branch, which is accepted in the Court today.

Respondent No.2 is present in Court in person, represented by counsel and is identified by the Investigating Officer. She confirms that the settlement has taken place and further submits that she does not wish to press her complaint any further.

In view of the above and keeping in view of the fact that the parties have resolved their dispute before the Trial Court on 21.04.2018 and a Settlement Agreement dated 21.04.2018 has been executed between the parties and respondent No. 2 does not wish to press her complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

Accordingly, FIR No.336/2017 under Sections 420/354 IPC, Police Station Rajouri Garden and the consequent proceedings emanating therefrom are hereby quashed.
