O R D E R

% 14.09.2018 The Additional Public Prosecutor, on instructions from SI Ashwani, submitted that investigation into the FIR no. 184/2014 under Sections 420/120-B of police station Vasant Kunj (South) which was registered pursuant to the orders which are impugned has already reached the final conclusive stages, the report under Section 173 of Code of Criminal Procedure to be submitted before the appropriate court of cognizance within ten weeks hereof. He also submitted, on instructions, that in case the investigating agency intends to effect arrest of the petitioners No.2 or 3, they shall serve an advance notice of three days, provided they continue to join the investigation as and when called upon to do so. CRL.M.C. 1592/2016

Learned counsel for the petitioner submitted that in view of the aforementioned information given by the prosecutors, his instructions are that the petitioners seek permission to withdraw the present petition, reserving the contentions set out herein to be agitated, in the case an adverse order is passed on such report under Section 173 of Cr.P.C. by the concerned court of cognizance, by taking out appropriate remedies in accordance with law.

The petition and the applications filed therewith are dismissed as withdrawn.

The contentions of the petitioner are kept open and reserved. R.K.GAUBA, J.
