CORAM:
HON'BLE MS. JUSTICE MUKTA GUPTA
O R D E R
% 21.09.2016 By the present petition the petitioner seeks quashing of FIR No. 234/2012 under Section 354 IPC registered at PS Sangam Vihar on the complaint of respondent No.2 and the proceedings emanating therefrom on the ground that the parties have settled the matter. Respondent No.2 who is present in Court states that she has settled the matter with the petitioner and she does not wish to pursue the abovenoted FIR and the proceedings pursuant thereto. As per the status report it is revealed that besides the above-noted FIR the petitioner is involved in two other FIRs being FIR No.365/2013 under CRL.M.C. 1721/2016
Section 302 IPC and 27 Arms Act registered at PS Sangam Vihar and FIR No.392/2016 under Sections 323/341/506/34 IPC registered at PS Anand Parbat. The petitioner is in custody in case FIR No. 365/2013. Considering the conduct of the petitioner this Court is not inclined to quash the above-noted FIR. The fact that one of the reasons why the complainant wants to get the FIR quashed is her repeated harassment of coming to the Court is required to be viewed seriously. It is therefore directed that the learned Metropolitan Magistrate who is trying the case will summon the complainant only for one date on which date her entire examination and cross-examination will be conducted and no adjournment will be granted on whatsoever ground so that there is no harassment to the complainant.
With these directions the petition is dismissed. Copy of this order be communicated to the learned Trial Court. MUKTA GUPTA, J.
