W.P.(C) 3639/2016 & CM No.15557/2016 The petitioner has filed the present petition seeking directions to the respondents to recall and/or cancel the order dated 15.02.2016 received by the petitioner on 10.03.2016 being silent as to nonextension of lien as per rules of University of Delhi. The petitioner also seeks directions to the respondent No.4 to pass a speaking order to the petitioner's letter dated 21.04.2016.

Learned counsel for the petitioner submits that vide order dated 30.04.2014, the petitioner was granted extra-ordinary relief (without pay) with lien for a period of one year w.e.f. 01.05.2014. The same was extended for a period of one year from 01.05.2015 on the same

terms and conditions vide letter dated 20.04.2015. He further submits that on 15.02.2016, respondent refused to extend the extra-ordinary relief after 30.04.2016 as two years have elapsed and the same cannot be extended beyond the period of two years.

Learned counsel for the petitioner further submits that in terms of Rule 14.9 (5) of Rules of University of Delhi, in any exceptional cases, the Executive Council may grant extra-ordinary relief beyond a period of two years.

The petitioner vide letter dated 21.04.2016 requested respondent No.4 to extend the extra-ordinary relief, but the same has not been decided so far.

Mr.Mohinder J.S. Rupal, Advocate appearing on behalf of respondent Nos.2 to 4 on advance notice submits that the petitioner's representation dated 21.04.2016 shall be decided within a period of one week by respondent No.4.

Mr.Vineet Chaudhary, learned counsel for the petitioner is satisfied with the aforesaid and submits that the petition and the application may be disposed of.

In view of the facts and circumstances of the case, it is deemed appropriate to dispose of the present petition as well as application with the direction that petitioner's letter dated 21.04.2016 shall be decided within a period of one week from today and the same shall be communicated to the petitioner.
